Act 206
Act 206 (signed into law November 30, 2004) aims to create a reasonable process to minimize municipal abuse and retaliation against builders. However, a certain degree of subjectivity with review & inspection fees will always exist.
Key provisions of the legislation include:
- Increase the amount of time given to the applicant to dispute an invoice
- Allows the applicant to appeal all invoices at once versus piecemeal
- Allows the appeal of invoices to occur upon the conclusion of the project
- Requires municipality to provide greater explanation for their charges
- Prohibits municipality from billing for duplicative inspections by other agencies
- Expands the list of “professional consultants” able to have their fees disputed
